Facing declining attendance figures for motorcycle events
across the country and legal action over its name,
organizers of the
Little Sturgis Rally are riding ahead.
Taking place in Sturgis Kentucky, the event has been held
for the last 15 years with up to 20,000 motorcycle
enthusiasts expected at this year's rally.
In March however, the Sturgis Area Chamber of Commerce
(South Dakota) filed a complaint of trademark infringement, false advertising, diluting a famous mark, unfair competition and deceptive trade. The Sturgis Chamber of Commerce says the Kentucky rally's use of the name "Little Sturgis Rally" gives the general public the false impression that the rally is endorsed or even licensed by the South Dakota rally.
Attorneys for Little Sturgis has sought to have the
complaint dismissed, saying the South Dakota court it was
filed in doesn't have jurisdiction over Kentucky.
In response, the Sturgis, S.D., Chamber of Commerce said
Little Sturgis' "intentional conduct was uniquely aimed at
South Dakota."
"Defendant's use of 'Little Sturgis' is a clear reference to
the plaintiff's mark and constitutes a deceptive attempt to
affiliate itself with the bigger, distinct and famous rally
that takes place in and around Sturgis, S.D.," wrote Michael
P. Reynolds, attorney for the South Dakota group.
Little Sturgis organizers feel the federal complaint
won't have any negative effect on the event.
Drawing in attendees, a $15,000 cash door prize, live
music, poker run, bike show and dirt race tracks. The Little
Sturgis Rally is scheduled for July 17-20 and will celebrate
its 16th year, with 2000 people attending the event in 1993.
Last year 17,000 enjoyed the event.
